Email Compliance Policy

Restoration Media Inc. has recognized the need to implement and enforce email compliance policies that ensure the delivery of legitimate email.

Restoration Media Inc. does not send “unsolicited commercial email(s)”.

Restoration Media Inc. maintains at all times a strict compliance with the Controlling the Assault on Non-solicited Pornography and Marketing Act of 2003 (Can-Spam), and any amendments or modifications thereto.

Restoration Media Inc. does not send “commercial email(s)” to an individual's e-mail address unless one of the following situations exists:


• Prior “affirmative consent” of the individual has been obtained, as defined by the CAN SPAM Act of 2003; or 

• Prior “consent” of the individual has been obtained as defined by the European Commission Privacy and Electronic Communications Directive


Every commercial email that Restoration Media Inc. sends includes an unsubscribe link to a web page (the “Unsubscribe Page”) which will enable the individual to unsubscribe from an offer, advertisement, promotion and/or brand in a commercially reasonable manner. Each unsubscribe request shall be given effect within no more than forty-eight (48) hours;

Restoration Media Inc. scrubs every email against any do not email list that may be applicable to any commercial email(s) and offer or against any suppression list that maybe applicable;

Restoration Media Inc will not distribute any obscene or unlawful commercial email(s) that contain(s) or promote(s): (i) the use of any illegal substance; (ii) pornography, tobacco, firearms; (iii) expletives or inappropriate language; (iv) racism or racial hate; and/or (v) illegal activity including without limitation mail fraud, illegal advice, infringement of intellectual property, export violations, viruses, worms, and/or any commercial email(s) that contain(s) or promote(s) fraudulent activity, goods, services, schemes or promotions;

Gathering of Email Addresses

Emails addresses were/will be gathered, obtained, collected and compiled without employing email address harvesting, dictionary attacks and/or any other deceptive or illegal act or practice;

All email addresses used in the deployment of commercial email(s) must have the following information “Opt-In Data”, record of affirmative consent (whether direct or by way of the right to transfer commercial emailing rights to a “third party”), first and last name.

Definitions:

“Affirmative Consent” (as defined by the U.S. CAN SPAM Act of 2003): The recipient expressly consented to receive the message, either in response to a clear and conspicuous request for such consent or at the recipient's own initiative; and if the message is from a party other than the party to which the recipient communicated such consent, the recipient was given clear and conspicuous notice at the time the consent was communicated that the recipient's electronic mail address could be transferred to such other party for the purpose of initiating commercial electronic mail messages.

“Consent” (as defined by the European Commission Privacy and Electronic Communications Directive): Within the context of an existing customer relationship (where a natural or legal person obtains from its customers their electronic contact details for electronic mail, in the context of the sale of a product or a service), it is reasonable to allow the use of electronic contact details for the offering of similar products or services, but only by the same company that has obtained the electronic contact details in accordance with Directive 95/46/EC*. When electronic contact details are obtained, the customer should be informed about their further use for direct marketing in a clear and distinct manner, and be given the opportunity to refuse such usage. This opportunity should continue to be offered with each subsequent direct marketing message, free of charge, except for any costs for the transmission of this refusal.
*From Directive 95/46/EC: Consent shall mean any freely given specific and informed indication of his wishes by which the data subject signifies his agreement to personal data relating to him being processed.

“Commercial Email” means email messages, sent in volume, the primary purpose of which is the commercial advertisement or promotion of a product or service.

“Opt-In-Data” means the registrant information and whatever information was acquired when the individual registered on the website which must include at minimum: registrant Opt-In date/time (the “Date/Timestamp”), registrant Opt-In Internet protocol address (the “IP Address”), registrant Opt-In Uniform Resource Locator Source (the “URL Source”) and registrant Opt-In-email address (the “Email Address”).

“Third Party” means an entity other than the party designated or identified.

“Unsubscribe” means a mechanism through which an individual may request that he or she no longer receive commercial email.

“Unsolicited Commercial Email” means a commercial email sent without prior consent.
